Serving Henderson rideshare passengers and drivers hit by rideshare vehicles

The firm has no Henderson office. We work from a single location in Downtown Summerlin, at 1980 Festival Plaza Dr, Suite 460, Las Vegas, NV 89135.

You don't need to drive across the valley to get started. You can start with a phone call or a video meeting. If you're still recovering and can't get around easily, Attorney Jaklin Sookiassian can meet you at home or in the hospital.

Because we're open 8 AM to 6 PM every day of the week, you can reach us on a Saturday or Sunday too. We provide personalized attention to every client.

We serve people across Henderson, including Green Valley, Anthem, Seven Hills, Inspirada, Cadence, and Lake Las Vegas.

This page is for two groups: riders who were in the Uber or Lyft, and people in other vehicles who were hit by one. If you drive for Uber or Lyft and another driver hit you, see our rideshare accident lawyer page.

Where Henderson rideshare crashes happen

A rideshare trip moves differently from ordinary driving. The car slows down to find its rider, stops, waits, and then pulls back into traffic. At the other end, it does the same thing in reverse. Many rideshare crashes happen during those short stretches.

Situations that come up often include:

  • Sudden curb stops. A driver spots the rider late and brakes hard, or cuts across a lane to reach the curb.
  • U-turns after a missed pickup. A driver who passes the pin may turn around in the middle of the road.
  • Eyes on the app. Checking the next turn, a new request, or a message from the rider takes attention off the road.
  • Doors opening into traffic. A passenger getting out on the street side can open a door into a passing car or a bike lane.
  • Airport runs. Trips to and from Harry Reid International Airport often include merges on and off the I-215.

Rideshare pickups and drop-offs in Henderson tend to cluster around places such as:

  • the Green Valley Ranch area near I-215 and Green Valley Parkway
  • shopping centers around Sunset Road and Stephanie Street
  • the Water Street District downtown
  • the resort area where St. Rose Parkway meets Las Vegas Boulevard South
  • Lake Las Vegas
  • trips to and from Harry Reid International Airport on the I-215

Trips through the city use roads such as Eastern Avenue, Stephanie Street, Sunset Road, Green Valley Parkway, Lake Mead Parkway, Water Street, St. Rose Parkway (SR 146), I-11/US-95, and Las Vegas Boulevard South. Riders are also picked up and dropped off near junctions such as I-215 at Green Valley Parkway, Sunset Road at Stephanie Street, St. Rose Parkway at Las Vegas Boulevard South, and Lake Mead Parkway at Water Street.

Where the crash happened usually decides who writes the report. The Henderson Police Department generally handles crashes on city streets. The Nevada Highway Patrol covers freeways such as the I-215 and I-11.

Which insurance applies to an Uber or Lyft crash in Henderson

Under Nevada law, the coverage that applies to a rideshare crash usually depends on the driver's status in the app when the crash happened. There are three periods:

  1. App off. The driver is using the car for personal reasons, so the driver's own auto policy is generally where things start. Nevada's minimum liability limits are $25,000 per person and $50,000 per crash for bodily injury (NRS 485.185).
  2. App on, no ride. The driver is logged in and waiting for a request. Required coverage: At least $50,000 per person and $100,000 per crash for bodily injury, plus $25,000 for property damage (NRS 690B.470).
  3. Ride accepted through drop-off. From accepting a ride until the passenger gets out (NRS 706A.060). Required coverage: At least $1,000,000 in liability coverage per crash (NRS 690B.470).

Here is a Henderson example. Say you take an Uber home from the airport to Inspirada. Your driver is coming off the I-215 and misjudges the merge, and you're hurt. You were in the back seat on an active trip, so the coverage for the period from ride acceptance to drop-off is the one most likely to matter. Your trip screenshot is the record that shows you were on that trip.

Now change one detail. An hour later, the same driver is parked with the app on, waiting for the next request, then pulls out and hits a car on Eastern Avenue. The crash is the same kind of crash, but because the app status is different, a different coverage level applies.

If a different driver caused the crash, that driver's insurer is usually involved as well. Sorting out which policies apply is often the first thing we look at.

After a rideshare crash in Henderson: what to save

Smartphone with a blank screen on a wooden table

Most of the record of a rideshare trip is on your phone. Save it early so you still have it when you need it.

  • The trip itself. Take a screenshot showing the driver's name, the car, the route, and the time of the ride.
  • Any in-app crash report. If you reported the crash in the app, screenshot what you sent and any confirmation you got back.
  • The police report number. Get it from the Henderson Police Department or the Nevada Highway Patrol, depending on who responded.
  • Photos. Take pictures of the vehicles, the street, traffic signs or signals, and any visible injuries.
  • Other riders and witnesses. Write down names and phone numbers while you can still reach people.
  • Medical records and bills. Keep everything from your treatment, including records from facilities such as Henderson Hospital and St. Rose Dominican Hospital, Siena Campus.

It also helps to keep short notes on how you're feeling and what you've had to miss, like work days or appointments. If you don't have everything on this list, that's fine. Bring what you have to your first call.

If you were hit by an Uber or Lyft while walking or biking in Henderson

Rideshare cars spend a lot of time near crosswalks, curbs, and bike lanes, so people on foot or on a bike are sometimes the ones who get hurt. The questions about which insurance applies still turn on what the driver was doing in the app. Our page on pedestrian accident claims explains more about these cases.

Nevada deadlines and shared fault

In Nevada, you generally have two years from the date of the injury to file a personal injury lawsuit (NRS 11.190(4)(e)). Treatment and recovery can take up much of that time, so it's worth asking questions early.

Fault isn't always one-sided in rideshare crashes. A passenger may have opened a door, or a driver may have stopped somewhere unexpected. You can recover compensation even if you were partially at fault — as long as your share of fault is 50 percent or less. Your recovery will be reduced by your percentage of fault.

If a Henderson rideshare claim goes to court, larger injury lawsuits are usually filed in the Eighth Judicial District Court. Smaller civil cases may be heard in Henderson Justice Court.
